The statute of limitations sets a time limit on how long you have to initiate legal proceedings after an event has occurred. This applies to Personal injury, property damage, car accidents, etc. Once this time period expires, you generally lose the right to file a lawsuit. Statues of limitations are designed to promote fairness and legal certainty by ensuring cases are brought when evidence is still fresh and available.
Key Statute of limitations periods in Washington state
Personal injury: 3 years from the date of injury
Property damage: 3 years from the date the damage occurred
Medical Malpractice: 3 years from the act or omission, or 1 year from discovery (whichever is later), with a maximum of 8 years from the act.
Wrongful death: 3 years from the date of death
exceptions- Incidents involving minors: under RCW 4.16.190 If a person entitled to bring a legal action is under the age of 18 at the time the cause of action accrues (when the injury or event happens), the statute of limitations is tolled- meaning it doesn't begin to run- until they turn 18. This rule only applies is the minor is the plaintiff, the one bringing the claim.
when it can be paused- The injured party is a minor, the defendant is out of state or cannot be located, the plaintiff is mentally incapacitated, the injury was not discovered immediately.
